PART II GENERAL LEGISLATION Chapter 34 Air Pollution

34-1  Prohibited fuels

 

No person, firm or corporation shall fire any heating plant, boiler or ther heating apparatus with soft coal or any other material which may cause a volume of soot, particles of flammable matter or black smoke which may cause damage to property or be detrimental to the public health; and no person, firm or corporation shall permit any other person in his employ so to do.

 

34-2  Permitted fuels

 

No person, firm or corporation shall fire or permit any person in his employ to fire any furnace, boiler or their heating apparatus within the corporate limits of the village except with hard coal, coke, smokeless coal, wood or fuel oil.

 

34-3  Smokestack requirement

 

All smokestacks within the village must extend at least seventy (70) feet vertically from the top of the furnace, boiler or other heating apparatus served by such stacks.

 

34-4  Cleaning of flues permitted

 

All persons, firms and corporations shall be allowed to show smoke from chimneys and stacks for a five minute period in the morning and a five minute period in the afternoon of each day, if necessary in order to clean the flues in any furnace, boiler or other heating apparatus.

 

34-5  Penalties for offenses1

 

A violation of this chapter shall be punishable, upon conviction, by a fine or imprisionment, or both, as provided in Chapter 1, General Provisions, Article II.  Each day on which any such violation continues shall constitute a separate offense.
