Chapter 62 Curfew

Body:

62-1 Curfew Established.  It shall be unlawful for any child under sixteen (16) years of age to loiter, idle, wander, stroll, play or remain inor upon any public place, including but not limited to public streets, alleys, parks, playgrounds, buildings, vacant lots and other public places, in the village between the hours of 10:00 p.m. and 6:00 a.m., unless such child is accompanied by his or her parent or adult guardian having legal custody and control of such child.

 

  62.2  Violators to be taken into custody.  Any child under sixteen (16)years of age loitering, idling, wandering, strolling, playing or remaining in or about any public place, including but not limited to public streets, alleys, parks, playgrounds, buildings, vacant lots and other public places, in the village between the hours of 10:00 p.m. and 6:00 a.m. may be taken into custody by any peace officer or any member of the Village Board, in which event such child shall be taken to the home of his or her parents or legal guardian, who shall be notified of such violation.

 

  62.3  Liability of parent or guardian.  It shall be unlawful for the parent, guardian or other adult having the care and custody of a minor under the age of sixteen (16) years to permit such minor to be in any public place between the hours prescribed and set forth in 62.1 of this chapter.

 

  62.4 Penalties for offenses.  A.  Each violation of any of the provisions of this chapter shall constitute a separate offense.  B.  Any parent, guardian or other adult having the care or custody of a minor adjudged to have violated any provision of this chapter shall be punishable, upon conviction, by a fine or imprisonment, or both, as provided in Chapter 1, General Provisions, Article II.1
